Appeal by the defendants, Townsend Davis and others, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of Erie on the 20th day of January, 1898, upon the verdict of a'jury, and also from'an order entered in said clerk’s office on the 14th day of January, 1898, denying the defendants’ motion for a new trial made upon the minutes.

Plaintiffs were copartners carrying on business in the city of Buffalo under the style of Shepard Hardware Company, in February, 1893, owning property xVhicli they desired to have insured.

The defendants were copartners in the fire insurance business in that city, and had, prior to the 23d of February, 1893, issued divers insurance policies to the plaintiffs, who, according to the complaint, applied to the defendants and requested of them additional insurance against' loss or damage by fire “ in good companies duly authorized to do and transact business within the State of Hew…
