Action on a life insurance policy. Defendant insured the life of plaintiff’s husband in the sum of $10,000, but now *293resists payment on the ground that the policy lapsed before the death of the insured. On June 22, 1928, an annual premium of $608 became due. The insured applied to the defendant for an extension of time within which to pay the premium, accompanying the application for an extension with a check for $116.80.
