Plaintiff in the court below claimed of the defendant $5,000 damages for the breach of a contract as set out in count 1 of the complaint in words and figures as follows, to wit: “Plaintiff claims of the defendant the sum of Five Thousand ($5,-000.00) Dollars as damages, for that heretofore on, to-wit, the 1st day of June 1934, that the defendant was engaged in doing a regular banking business in the City of Mobile, State of Alabama; that the plaintiff entered into a contract with the defendant, through one of the defendant’s agents, whose name is otherwise to the plaintiff…
