FOURNET, Chief Justice.

The defendant, S. W. Tarver, having been charged, tried and convicted on the 2nd day of April, 1956, in the City Court of Pineville, on an affidavit charging him with (1) being drunk, and (2) “also in possession of intoxicants, using and storing alcoholic liquors containing more than 6 per cent, alcohol” in violation of Ordinance 365 of the City of Pineville, on the 4th of April was granted a new trial on motion of counsel he had employed in the meantime; and following the overruling of defendant’s motion to quash the affidavit, a new trial was had on the charges set…
