Appeal by the relator, William J. Rodgers, from an order of the Supreme Court, made at the Yew York Special Term and entered in the office of the clerk of the county of Yew York on the 26th day of June, 1900, denying his motion for a peremptory writ of mandamus.

The appellant applied to the court below for a mandamus requiring the respondent to deliver to him a warrant .on the chamberlain of the city of Hew York for the payment of the sum of $2,863, the amount earned under a contract for regulating and grading One Hundred and Thirty-fifth street, from Amsterdam avenue to the Boulevard, and to make the said payment under the said contract. This application was founded upon an affidavit which alleges that the relator made and entered into a contract with the city of Hew York, whereby the relator agreed to regulate and grade West One…
