FOLEY, District Judge.

This action was commenced in the Supreme Court of the State of New York, Schenectady County. Pursuant to Title 28 U.S.C.A. § 1446, a petition by the defendants for the removal of the action was filed in this district court. The action of the plaintiffs is equitable in its nature, seeking an accounting and injunctive relief. Approximately on the same date the defendants complied with the requirements of section 1446 as to the filing of the bond and written notice to adverse parties, temporary injunctive relief pendente lite was granted by the State court to the…
