MEMORANDUM OPINION

OREN HARRIS, District Judge.

This matter is before the Court on motion of the defendant, United States of America, to dismiss the complaint of the plaintiff on the basis that the injured party, Lawrence Waters, was an employee of the Pine Bluff Arsenal at the time of the alleged injury pursuant to Vocational Education Act of 1963, as amended, and as such employee, he has been awarded compensation by the Bureau of Employees Compensation.
