By the 24th section of chapter 210, of the laws of 1857, p 343, the city of Dubuque was constituted *271one permanent school district, subject to the council of said city, whose duty it was to provide for the adequate support and maintenance of common schools in said district. By the same act, the city council was required to provide for the appointment of a board of education, to whom should be given the management of the common schools of the district.
