I dissented from this court’s opinion in Gray v. Hercules Powder Co., 160 Kan. 767, 165 P. 2d 447, and, based on reasons stated in the dissenting opinion of former Justice Hoch, I still believe the majority of the court reached a wrong conclusion in that case.
