MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This matter comes before the Court on the motion of defendant for judgment notwithstanding the verdict or for a new trial. Trial of this action occurred in December, 1978, and primarily concerned the applicability of exclusion (k) in a policy issued by defendant insurer. The jury in a special verdict determined that the exclusion was inapplicable, and the Court on December 8, 1978, ordered that judgment be entered for plaintiff. On December 18,1978, defendant filed the instant motion. Oral argument was heard January 9, 1979.
