MONTGOMERY, Presiding Judge.

This is a trespass case tried before a jury. Plaintiff received a judgment against Defendants for $1,000 nominal damages after the trial court determined Plaintiff failed to prove actual damages.1 At the close of Plaintiff’s case the trial court directed a verdict in favor of Defendants regarding the submissibility of Plaintiff’s claim for punitive damages. At the same time and without protest from Defendants, the trial court directed a verdict for Plaintiff against all Defendants, instructing the jury to award Plaintiff nominal damages.
