Hawkins v. Great Northern Railway Co.

Action in the district court for Ramsey county by the administratrix of the estate of Michael Hawkins, deceased, to recover $5,000 for his wrongful death. The case was tried before Hallam, J., and a jury which rendered a verdict in favor of plaintiff for the amount demanded. From an order denying defendant’s motion for judgment notwithstanding the verdict or for a new trial, it appealed.

Plaintiff’s and respondent’s deceased, a car repairer, was employed on defendant’s and appellant’s repair track. There were five of these tracks, numbering 1 on the north to 5 on the south, which lay parallel to each other and extending from east to west. Between the two most southerly tracks, 4 and 5, was a narrow tramway for the operation of a truck. The space between its rails was filled with planking.
