On October 6, 1977, in Commonwealth v. Goldman, 5 Mass. App. Ct. 635 (1977), we affirmed Goldman’s convictions of robbery while armed and masked and attempted kidnapping. On February 26, 1980, Goldman moved for a new trial on the grounds (1) that he was denied *700effective assistance of counsel due to a conflict of interest on the part of his trial attorney, and (2) that he was denied a fair trial because the trial judge failed to hold a hearing sua sponte on his competency to continue with the proceeding^.
