HENLEY, Circuit Judge.

Bobby Joe Weiland, an inmate of the Nebraska State Penitentiary, appeals from an order entered by the United States District Court for the District of Nebraska 1 denying his petition for a writ of habeas corpus filed pursuant to 28 U.S.C. § 2254.

In 1970 petitioner was convicted by a jury in the District Court of Dodge County, Nebraska of the offense of breaking into and entering the Shamrock Bar in the City of Fremont, Nebraska, and was sentenced to imprisonment for a period of twelve years.
