Clarence E. Twilbeck, Sr. filed a suit against his brother,"' Hermen^J. "Twilbeck, for the sum of $2500.00 with interest at the rate of 1% per month, alleging that he is the holder and owner for valuable consideration before maturity of a certain *908promissory note for the sum of $2500.00, dated May 19, 1955, executed by Hermen J.
