OPINION

MATHIAS, Judge.

Cathy Thayer (“Thayer”) was employed at Lafayette Clinic, Inc. at which Dr. Michael OrRieo (“OrRieo”), a psychologist, maintained his professional practice. While she was employed at the Clinic, Thayer sought OrRico’s advice concerning problems she was having with her children and her marriage. In 1999, Thayer and her husband filed a complaint against Or-Rico in Tippecanoe Superior Court alleging in part that OrRieo and Thayer had a therapist-patient relationship, and that Or-Rico committed medical malpractice in his treatment of Thayer.
