In an action pursuant to RPAPL article 15 to determine claims to certain real property, the defendant appeals from so much of an order of the Supreme Court, Kings County (Jackson, J.), dated January 13, 1995, as, upon denominating its motion for partial summary judgment dismissing the second cause of action in the amended complaint as a motion to reargue, denied the motion. Justice Krausman has been substituted for the late Justice Hart (see, 22 NYCRR 670.1 [c]).
