OPINION AND ORDER DENYING PETITION FOR WRIT OF HABEAS CORPUS 1

TARNOW, District Judge.

I. Introduction

This case is before the Court on remand from the Sixth Circuit Court of Appeals. The Court of Appeals reversed the previous judgment of this Court granting habe-as corpus relief to Petitioner David Patrick Lakin. The Court of Appeals remanded the case “for further proceedings on the remaining claims advanced in the petition.” Lakin v. Stine, 80 Fed.Appx. 368, 378-79 (6th Cir.2003).
