Appeal by the plaintiff from an order of the Municipal Court of the city of New York, borough of Bronx, second district, sustaining a demurrer to plaintiff’s complaint.

This is an appeal from an order of the Municipal Court sustaining a demurrer to the plaintiff’s complaint. The order appealed from is merely an indorsement upon the summons of the words: “ Demurrer sustained.” No formal order and no in*92terlocutory judgment is in the record.
