Homes by Deltona, Inc. (Deltona) appeals, and Outdoor Site Solutions (OSS) cross-appeals, the final judgment entered by the trial court in favor of OSS..We reverse.

Deltona owned undeveloped property located in St. Johns County. Deltona contracted with OSS to provide labor, services, and materials which included ¡fill dirt. OSS thereafter entered into a verbal contract with Hicks’ Trucking and Fill, LLC (Hicks), pursuant to which Hicks agreed to furnish OSS with fill dirt, labor, and services for the Deltona project.
