BURKE, Chief Justice.

In his complaint in this action, the plaintiff, John A. Hook, alleged conversion by the defendants, John P. Crary and V. W. Crary, of 1,272.54 shares of stock of American Life and Casualty Insurance Company of Fargo. The trial of the case, which was before a jury, resulted in a verdict for the plaintiff and judgment in favor of the plaintiff in the sum of $62,376.10. After *144judgment, the defendants moved for judgment notwithstanding the verdict or, in the alternative, for a new trial.
