The pertinent facts in this case are that on March 24, 1942, Ralph S. Silver established the Ralph Silver Trust with The Cleveland Trust Company as trustee. The Ralph Silver Trust became irrevocable upon Ralph Silver’s death on November 12, 1957. After Ralph Silver’s death, the trust agreement provides for payments of the net income and such amounts of trust principal as the trustee may deem necessary and proper for maintenance, comfort, and support to Ruth Silver, Ralph Silver’s wife, for her lifetime.
