In an action to foreclose a mortgage, plaintiff appeals from a judgment of the Supreme Court, Queens County (Sherman, *673J.H.O.), entered January 23, 2004, which, after a nonjury trial, dismissed the complaint and vacated the notice of pendency filed against the mortgaged premises.

Ordered that the judgment is affirmed, with costs.

The trial record supports the conclusion of the Judicial Hearing Officer that the plaintiff, an attorney at the time of the underlying loan transaction, failed to provide full disclosure to his client, the defendant George Billis, regarding the parties’ divergent…
