The defendant, John Ryan, was informed against for the murder of William Kerr on September 13., 1908. He was a man then about fifty-eight years old, and lived at the St. Louis House at Twenty-first and Blake streets, Denver. On the afternoon of that day he had' trouble and an encounter with John McLaren and Archie Lang, and as a result thereof was somewhat bruised and wounded.
