JOHNSON, Circuit Judge.

This is an application, on the part of the defendant company, to set aside an order, entered on the 3d day of April, 1S76, that being the first Monday of April in that year, and the first •day of the April term of this court, in the •equity rule book, by which it was ordered that the above cause should proceed in this court in the same manner as if the same had been originally brought in this court.
