Hubbs, P. J.:
The defendant was a police officer of the city of Buffalo, N. Y. The testimony, on the part of the People is to the effect that while on duty and in uniform, on the night in question, he and another police officer, also in uniform, broke and entered a building and took therefrom certain personal property. The conviction rests 'apon the testimony of the janitor of an adjoining theatre. His testimony is almost unbelievable in some regards. He was corroborated in some respects, however.
