Prior to 2000, the Massachusetts Highway Department (MHD) provided some of its union engineers with free *92parking at its headquarters located at Ten Park Plaza in Boston.3 This action arose out of the decision by the Commonwealth, as employer, acting through the Executive Office for Administration and Finance (EOAF), to unilaterally implement, for the first time, mandatory reporting and withholding requirements on the taxable portion of the value of those fringe benefits.
