The issue for determination is whether regulations of the Department of State, under which the Secretary of State revoked the passport of Philip Agee, are unconstitutional on their face and as applied. Agee, a former agent of the Central Intelligence Agency (CIA), concedes in this case that his international travel activities “have caused serious damage to the national security and foreign policy of the United States” and that his “stated intention to continue such activities threatens additional damage of the same kind.” (App. 9, 29) The District Court held that while such grounds may be…
