This immigration case is before the court on Plaintiff’s motion for summary judgment and on Defendants’ motion to dismiss or, in the alternative, for summary judgment.
Plaintiff seeks judicial review of a final administrative decision of the United States Immigration and Naturalization Service (INS). 1 That decision denied Plaintiff the waiver which he sought of the two-year foreign residency requirement imposed upon him by § 212(e) of the Immigration and Nationality Act, as amended, 8 U.S.C. § 1101, et seq.
