This case comes before the court on defendant’s motion, filed November 25, 1977, pursuant to Rule 141(b), requesting that the court adopt, as the basis for its judgment in this case, the recommended decision of Trial Judge David Schwartz, filed September 22, 1977, pursuant to Rule 134(h), neither of the parties having filed a notice of intention to except or exceptions thereto and the time for so filing pursuant to the Rules of the court having expired.
