RUIZ-NAZARIO, District Judge.

Defendants have moved to dismiss the amended complaint in this action, alleging (a) that this court lacks jurisdiction over the subject matter and over each of the defendants in this case, and (b) that the amended complaint fails to state facts upon which relief can be granted.

They concede that the action is one for declaratory relief under Title 28 U.S. C.A. § 2201 instituted pursuant to Title 8 U.S.C.A. § 1503(a), but contend however, that the facts alleged in the amended complaint fail to meet the requirements of the latter section and that, thus, the plaintiff…
