The plaintiff below, Miss Lou Saucier, is the plaintiff in error here. In this opinion, the parties will be called plaintiff and defendant, respectively, as they appeared on the record in the trial court.

Plaintiff brought this suit in the Third circuit court of Davidson county, on April 29, 1925, and thereafter filed a declaration in four counts, the first count being in these words:
