This is an article 78 proceeding in which petitioner seeks review of a determination of the State Liquor Authority (SLA) which suspended petitioner’s license for 10 days, directed that a demand be made on petitioner and its surety on the bond of $1,000 and directed a letter of warning. The procéeding was transferred to this court pursuant to CPLR 7803 and 7804. The central facts are not in dispute.

Petitioner was charged with a violation of subdivision 5 of section 100 of the Alcoholic Beverage Control Law for selling liquor on credit. The second charge was a refusal to answer…
