Walker and Jones were jointly indicted for the murder of Holton. Walker was separately placed on trial, and convicted. He submitted a motion for a new trial, which being overruled, he excepted. We reverse the judgment of the court below overruling the motion for a new trial on the grounds that the evidence as it appears in the record does not show beyond a reason? able doubt that the accused was guilty of the offense as charged, and because of certain rulings made by the trial judge, which will be'hereafter considered.
