MOLYNEAUX, District Judge.
This action is here on writ of error. The plaintiffs in error will be referred to hereafter as “defendants” ; the defendant in error, as “plaintiff.”
This is an action at law for the recovery of money only. A jury was waived and the eause was tried to the court. The court found generally for the plaintiff and noted in his findings, “to which ruling of the court defendants severally except.” The court filed a memorandum opinion in the case. No special findings of fact were made by the court, nor were any. such findings requested by the defendants. No demurrer was filed…
