Affirming on the cross-appeal and reversing on the original appeal.

Plaintiff, J. H. Newland, who was severely injured while engaged in blasting work for the defendant, Louisville & Nashville Bailroad Company, brought this suit against the defendant to recover damages. The first trial resulted in a verdict in his favor for $20,000.00. A new trial was granted, and on the second trial he recovered a verdict for $15,000.00.
