—Judgment, Supreme Court, New York County (Michael Obús, J.), rendered July 9, 1996, convicting defendant, after a jury trial, of assault in the first degree and criminal possession of a weapon in the third degree, and sentencing him, as a second felony offender, to concurrent terms of 3 to 6 years and 2 to 4 years, respectively, unanimously affirmed.

Defendant’s motion to set aside the verdict on grounds of alleged violation of Brady v Maryland (373 US 83) as well as newly discovered evidence was properly denied. The 14-year-old out-of-State misdemeanor conviction record of the complainant…
