—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Walter Thompson (plaintiff) sustained injuries when he fell from a ladder while painting a house owned by defendant, his landlord. Supreme Court properly granted plaintiffs’ motion for partial summary *1125judgment on liability under Labor Law § 240 (1). We reject defendant’s contention that plaintiff was not an employee entitled to protection under Labor Law § 240 (1).
