The petitioner alleges, that she leased of the defendant a hotel in the city of New Orleans for the term of four years, at the rent of $ 12,500 per annum, payable quarterly, to secure which sum she gave sixteen notes, four of which were delivered to the defendant on the 1st of November, 1838, when the lease commenced, and the others were deposited in the bank to be delivered annually. She also avers, that said hotel was to be delivered on the day mentioned, in good order and condition, with all the necessary appurtenances, so that she could open it for the reception of company immediately,…
