Commonwealth v. Avalos

Massachusetts Supreme Judicial Court

Decided May 28, 2009PublishedCited by 13 opinions

1Opinion of the CourtCordy, J.

After a jury trial, the defendant, Salvatore Avalos, was convicted on three indictments charging rape of a child in violation of G. L. c. 265, § 23, and three counts of indecent assault and battery on a child under fourteen, in violation of G. L. c. 265, § 13B. On appeal, Avalos claims that the trial judge erroneously restricted defense counsel’s cross-examinations of Commonwealth witnesses, preventing Avalos from exposing then-bias, prejudice, and motives to lie. We transferred the case from the Appeals Court on our own motion. We affirm the convictions.
