In an action to recover damages for personal injuries, the defendants City of New York, New York City Police Department, and Sean M. Walker appeal, as limited by their brief, from so much of an order of the Supreme Court, Queens County (Plug, J.), dated June 25, 2009, as denied their cross motion for summary judgment dismissing the complaint insofar as asserted against them on the ground that the plaintiffs did not sustain a serious injury within the meaning of Insurance Law § 5102 (d), and the defendant PV Holding Corp. separately appeals from the same order.
