Judgment was rendered in this action against the defendants for a foreclosure of the mortgage and for a sale of the real estate therein described. Such judgment was affirmed upon appeal to the Appellate Division of the Supreme Court, and from that judgment two of the defendants,. David O. .Robinson and Emma, his wife, have appealed to the Court of Appeals. ¡Neither of such appellants is liable for any deficiency arising upon the sale, and neither of them is in possession of any of the mortgaged premises.
