Plaintiff Mary Nisi filed this putative class action lawsuit alleging that Defendant Dorothy Brown, in her official capacity as Clerk of the Circuit Court of Cook County ("the Clerk"), violated the Driver's Privacy Protection Act ("DPPA"), 18 U.S.C. § 2721, et seq. , by improperly disclosing personal information derived from motor vehicle records. The Clerk subsequently filed a motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6), asserting among other things that Nisi's claim is barred by the Eleventh Amendment.…
