MEMORANDUM OPINION
(April 11, 2014)
Pending before the Court are Defendant Virgin Islands Telephone Corp.’s October 24, 2013, Motion for Summary Judgment1 and Plaintiff *108Taynacleone Creque Hodge’s November 4, 2013, Cross-Motion for Summary Judgment.2 For the following reasons Defendant’s Motion shall be denied and Plaintiff’s Motion shall be granted.
