CHRISTIAN, Judge.

Under indictment charging him with murder, appellant was convicted of assault with intent to murder, and his punishment assessed at confinement in the penitentiary for two years.

Deceased, Ed Smith, was appellant’s tenant. Apparently the relations of the parties had been unfriendly; it appearing that appellant had given deceased notice to surrender possession of his farm. Shortly prior to the homicide appellant had advised Mr. Peel that he had a landlord’s lien on certain crops raised by deceased.
