Appeal by the defendant from a judgment of the Supreme Court, Queens County (Joy, J.), rendered February 27, 1990, convicting him of manslaughter in the first degree and criminal possession of a weapon in the second degree (two counts), upon a jury verdict, and sentencing him to consecutive indeterminate terms of 7 to 21 years imprisonment, 4 to 12 years imprisonment, and 4 to 12 years imprisonment.

Ordered that the judgment is modified, on the law, by vacating the sentence imposed; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Queens County, for…
