This is a taxpayer’s action brought by a resident of the late town of Jamaica to enjoin the defendant, the city of Hew York and its officers, from levying any tax for the purpose of making payment, and from making any payment, on account of the contract made December 17th, 1897, between the town board of the town of Jamaica and the defendant, the Jamaica Electric Light Company, on the ground that such contract was illegal.
