Reversing.

This is an action under the declaratory judgment act. On the 8th day of September, 1919, George H. Robson died intestate, the owner of several pieces of real estate situated in Campbell county, Kentucky, and leaving surviving him as his only heirs at law his widow, Clara Robson, appellee herein, and their son, George Haddon Robson, an infant of seven years of age, who by his guardian ad litem is the appellant herein.
