— Defendant was charged with violation of section 620, subsec. (h), of The Vehicle Code of the Commonwealth of Pennsylvania and, on April 10, 1948, defendant and William Barnhart entered into a recognizance, before the justice of the peace, as principal and surety respectively, for the sum of $500, the condition of which recognizance is as follows:
