This is an action brought in the circuit court of Kankakee county to the May Term 1928 to recover damages for the alleged wrongful death of plaintiff’s intestate, sustained in a collision between a locomotive of the Cleveland, Cincinnati, Chicago and St. Louis Railway Company and an automobile of the defendant.
